18 June 2024 Keith Rix 1870 Case Updates IXF, R (On the Application Of) v Chief Constable of West Mercia Police [2023] EWHC 2793 (Admin) byKeith Rix “Don’t forget the reasons” The case On 5 September 2019, the Claimant was arrested by officers of the West Mercia Police, and kept in custody overnight. He was bailed the next morning. On 9 September 2019, the Claimant's mother made a complaint to the West Mercia Police ("WMP") about the treatment of her son by the police during that period. That complaint was "not upheld" by a Senior Complaints and Misconduct Manager in the Professional Standards Department of the WMP. The Claimant appealed. The Defendant's Independent Appeals Panel agreed with the original finding, and the appeal was "not upheld". That was the decision challenged in this claim.
