Mr Brodie QC made much in cross-examination of Professor Dr Zollner's and Professor Dr Brandstetter's failure to include the expert's declaration pursuant to paragraph 9.1(i) of FPR Practice Direction 25B in their respective reports, he failed to persuade me that this was a matter of substance that had impacted upon their written and oral evidence.
