Hot-tubbing: Practical approach or unpopular gimmick?

The giving of concurrent evidence ("hot-tubbing") will be examined in detail, starting with the definition in Practice Direction 35 and looking at practical obstacles to its implication in court.
The psychological impact of hot-tubbing with be covered, with learning points for expert witnesses who are faced with hot-tubbing. The session will culminate in a discussion with attendees to see whether there is a consensus amongst the expert witness community as to whether hot-tubbing should be more widely adopted or discouraged.

  • Cancellations received 26 -50 business days prior to the event – A 75% refund will be given.
  • Cancellations received 16-25 business days prior to the event – A 50% refund will be given.
  • Cancellations received less than 15 business days prior to the event – no refund will be given.

Please note, any delegates who do not attend on the day will not receive a refund.  Access to the event will be denied if payment in advance has not been made.

The EWI reserve the right to cancel any event with a minimum of 3 business days’ notice and will provide a full refund to delegates.

The panel 

Stathis Maliakis BSc., BSEE, MSc., QM, ISO CertLA, CDPO

Expert Witness and Head of Power, EMEA

Efstathios (“Stathis”) is Head of Power at DAC Consulting Services in EMEA and a highly regarded Expert Witness in construction sector disputes.

Stathis has 20 years of experience as an Electrical Engineer including more than 10 years with P.P.C. S.A. supervising the construction of Electrical and I&C parts in power plants, including IT & Telecommunications infrastructure. He has been working as an expert witness since January 2021.

Stathis leads technical consultancy teams supporting complex arbitration, construction claims and loss adjustment cases. He has extensive experience in claims and disputes arising from power equipment design, installation, commissioning, and operations, in which he has served as a Forensic Investigator, RCA Expert, Claims Evaluator, Expert Witness, and Subject Matter Expert.

Stathis has a deep interest in, and commitment to, continuing education and lifelong learning and, for the last 6 years, he has been conducting training courses for engineers in large corporations across the middle east. He holds a BSc in Electrical Engineering and a Master of Science in Quality Management.


Alexandra Bodnar

Barrister, Keating Chambers

Alexandra Bodnar is a sought-after barrister specialising in the litigation and arbitration of UK and international construction and commercial matters. She regularly represents clients in the English Technology & Construction Court and Commercial Court, as well as in front of international and domestic arbitral tribunals. Her work involves high-value, complex construction, engineering, infrastructure and energy projects across the globe. This includes PFI projects, EPC projects and substantial commercial supply projects. Much of her work involves allegations of professional negligence against construction professionals and claims concerning significant damage to property.

She has particular expertise in bonds and guarantees, both within the construction sector and concerning business matters more generally. This includes claims for injunctions to restrain guarantee demands, and insurance coverage and avoidance matters.

In addition to acting as an advocate in adversarial proceedings, she advises clients. She also represents clients in alternative dispute resolution proceedings, such as mediation and UK construction adjudication (including adjudication enforcement claims).
